My Part Time Employee only works 2 days a week, what is their Sick Entitlement?
All Permanent Staff are entitled to 10 Days of Sick Leave per annum, regardless of how many days a week they work.
The first allocation of Sick Leave is after six months from their commencement date, and then annually thereafter (18 months after their commencement date).
There is no pro-rata of the 10 days entitlement at all, so someone who works 1 day a week gets the same as someone who works 5 days a week. You are perfectly entitled to give an employee more days.
Casual Employees are also entitled to Sick Leave, see Related Article below.
Paying Sick Leave in Advance
You should be very cautious of paying Sick Leave in advance (that is greater than their current balance), because as the Law stands if an employee is sick for greater than 10 days per entitlement year, you must ensure that at least 10 of these are paid, for example:
John has a balance of 10 days of Sick Leave in January 2021, in June he was sick for 15 days, which you pay him for and now his balance is -5. In December he gets his next 10 days allocation so has a balance of 5 days.
In February 2022 he is sick again for 15 days and you only pay him 5 days, 10 being Unpaid Sick Leave.
This is incorrect as he is entitled to be paid for 10 sick days each entitlement year.
By Agreement with your Employee, you can get approval that any Sick Leave paid in Advance will be deducted from their next allocation, but without such agreement, any Sick Leave paid in Advance would be seen as a gift.
Employees can accrue up to 20 Days if they don't use all their allocation from one year to the next.
